Terms of Service

Last updated: July 22, 2026. Please read these Terms of Service (the “Terms”) carefully. They govern your access to and use of the Skybound websites, applications, and services (collectively, the “Services”). By creating an account, purchasing a product, or otherwise using the Services, you agree to these Terms.

1. Who We Are

The Services are operated by SKYBound Travel LLC and its affiliates (“Skybound,” “we,” “us,” or “our”). Node Licenses are sold by SKYBound DAO LLC and are governed by separate agreements as described in Section 5. In these Terms, “you” means the individual or entity using the Services.

2. Acceptance and Changes

By using the Services you represent that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services. We may update these Terms from time to time; material changes will be posted here and, where appropriate, notified by email. Changes are effective when posted, and your continued use of the Services constitutes acceptance of the updated Terms.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. The Services

Skybound offers: (a) a travel membership and booking platform (the “Travel Platform”); (b) node licenses that authorize you to operate node software on the SKYBound Network (“Node Licenses”); and (c) an affiliate program. Some features may be unavailable, in preview, or labeled “coming soon,” and we may add, change, or discontinue features at any time.

5. Node Licenses

Node Licenses are sold by SKYBound DAO LLC and are governed exclusively by the Node License Terms & Conditions, the Purchaser Acknowledgments, the Risk Disclosures, and the DAO Constitution (the “Node Documents”), which you must accept at checkout. In the event of any conflict between these Terms and the Node Documents with respect to a Node License, the Node Documents control. You acknowledge that a Node License is a software license, is not an investment, security, or profit-sharing interest, and that rewards are variable, algorithmic, and not guaranteed. Nothing on the Services is financial, investment, legal, or tax advice.

6. Travel Memberships

Where offered, travel memberships are recurring subscriptions billed monthly or annually at the price shown at checkout, until cancelled. By subscribing you authorize us and our payment processor to charge your payment method on each renewal. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period, and access continues until then. Except where required by law, subscription fees already charged are non-refundable. Member rates, rewards, and partner offers may change over time.

7. Affiliate Program

Participation in the affiliate program is subject to approval and to any additional affiliate terms we provide. Approved affiliates may earn commissions on qualifying sales they refer, at the rates shown in their dashboard. Commissions may be withheld, adjusted, or reversed in cases of refund, chargeback, fraud, self-referral, or violation of these Terms. We make no representation or guarantee of any earnings. You are an independent participant, not our employee, agent, or partner, and you are responsible for your own taxes.

8. Payments

Payments are processed by third-party payment processors (including Stripe). By providing a payment method you authorize the applicable charges, including recurring charges for subscriptions. You are responsible for all applicable taxes. Node sales are final except as stated in the Node Documents. You agree not to initiate a chargeback without first contacting us to resolve the issue.

9. Acceptable Use

You agree not to: (a) use the Services for any unlawful, fraudulent, or deceptive purpose; (b) make false or misleading claims about Skybound, the Node Licenses, rewards, or potential earnings; (c) infringe our or others’ intellectual property; (d) reverse engineer, decompile, or attempt to derive source code from the Services or node software except as permitted by law; (e) interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems; (f) use bots, scrapers, or automated means except as expressly permitted; or (g) violate any applicable law, including sanctions, export, anti-bribery, and anti-money-laundering laws.

10. Intellectual Property

The Services and all related content, software, trademarks, and materials are owned by Skybound or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. No rights are granted except as expressly stated. You may not use our name, logos, or marks without our prior written consent.

11. Third-Party Services

The Services may integrate or link to third-party products, providers, and websites that we do not control (for example, travel suppliers and payment processors). We are not responsible for third-party services, and your use of them may be subject to their own terms and policies.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY REWARDS, SAVINGS, OR RESULTS WILL BE ACHIEVED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYBOUND AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR DIGITAL ASSETS, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US FOR THE APPLICABLE PRODUCT IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS.

14. Indemnification

You agree to indemnify and hold harmless Skybound and its affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Except where prohibited, any dispute will be resolved in the courts located in New York, and you consent to their jurisdiction. CLASS ACTION WAIVER: to the extent permitted by law, all claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, and each party waives any right to a jury trial. For disputes concerning a Node License, the dispute-resolution provisions of the Node Documents control.

16. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or other users. Sections that by their nature should survive termination will survive.

17. Miscellaneous

These Terms, together with the Privacy Policy and any product-specific terms (including the Node Documents), constitute the entire agreement between you and Skybound regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely.
